Two men not being charged with hate crime in Alameda County

Being charged with a violent crime is serious. Violent crimes can lead to serious penalties, like long-term prison sentences. However, if any individual has been arrested and charged with multiple crimes, it is possible that some of the charges can be dropped due to plea agreements or simply because the prosecution doesn’t have enough evidence to support all of the charges.

Two California men were recently arrested and charged with several crimes after one of the men shot for people during an argument. Initial speculation by authorities pointed to the possibility of a hate crime. However, upon further examination, the Alameda County District Attorney’s Office decided not to pursue charges related to hate crimes against the two men.

According to sources, the two men and four individuals, one woman and three men, were all at a San Leandro nightclub got into an argument with one another. As the argument escalated, the men made comments about the groups sexual orientation. One of the men then went back to their vehicle and retrieved a “high-powered semi-automatic handgun.” The other man ordered the man with the gun to shoot the four individuals. He complied by shooting them in their feet and legs. Both men were arrested and charged with attempted murder. The alleged shooter is also being charged with four intentional discharge of a firearm enhancements, which could lengthen his prison term if he is in fact convicted.

If you have been arrested or charged with multiple criminal offenses, remember that all or some of those charges could possibly be dropped. The prosecution’s job is to prove all aspects of each charge beyond a reasonable doubt in order to be convicted. A criminal defense attorney’s job is to examine the prosecution’s evidence and expose any weaknesses in their case. If you have been arrested or charged with a crime, call a criminal defense attorney who is able to discuss what options are available.
