That's "scientific evidence:" It must be infallible, right?

Here's one definition of so-called "expert" opinion that is offered as testimony in criminal cases, when backed by seemingly cutting-edge technology: unerring and pristinely accurate analysis.

Here's another: junk.

And here's a third weigh in, suggested as an in-between compromise: opinion and educated guesses.

That last offering comes courtesy of an article on our website at The Law Office of John W. Noonan discussing the subjectivity inherent in much scientific evidence that features during criminal trials. That piece notes that, notwithstanding the luster -- we term it the "veneer" -- attached to such evidence, especially when its alleged sacrosanct quality is touted by those offering it, it is often anything but infallible.

In fact, it has been the case in a breathtakingly high number of instances that such evidence has led to wrong conclusions.

And that is a decidedly bad thing in criminal law, where judges and juries that are influenced by faulty evidence pronounce judgments that can easily -- and far too often do -- lead to draconian results against criminal defendants.

Put another way: People spend long, hard years in prison following an erroneous "scientific" assessment. Their lives are ruined. Some die during incarceration. In fact, some are executed by government authorities.

And then there's this, of course, as we note on the above-cited website page: "[A] guilty party has escaped prosecution and remains free."
